Overview

With the publication of Ordinance No. 848 in August 2023 by Brazil’s Ministry of Transport, a new policy framework for contract optimization and readjustment has emerged in the country, aiming to restore the private sector's confidence in long-term infrastructure investment. The regulation emphasizes public interest, legal and economic viability, and immediate improvements to operational performance in existing road concessions—especially those under distress or undergoing re-bidding processes.

This transformation comes at a pivotal time: Brazil is seeing a growing federal and state pipeline of highway projects, limited public funding for infrastructure, and a concerted effort from government, regulators, and the market to strengthen the country’s institutional environment. The optimization agenda enables the fast-tracking of priority works, anticipates timelines compared to new auctions, and allows for tariff reclassification mechanisms directly tied to the execution of physical investments—all while preserving affordability for users.

A unique round of discussions will take place in New York, bringing together top Brazilian public officials and leading investors to share insights on this evolving policy. It will be an opportunity to highlight Brazil’s commitment to regulatory modernization and demonstrate to international stakeholders the proactive steps being taken to create a more attractive, stable, and investable infrastructure environment.
